Welcome to RUSH, developed and operated by DevRelic LLC, a U.S. corporation headquartered at 30 N Gould St #46747, Sheridan, WY 82801, USA (“DevRelic,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the RUSH mobile applications (iOS and Android), website rushapp.ai, and related services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use RUSH.

1. General Terms

By downloading, accessing, or subscribing to RUSH, you confirm your agreement with these Terms and all related policies, including our Privacy Policy, Refund Policy, and Subscription Terms.

Under no circumstances shall DevRelic LLC or its affiliates be liable for any direct, indirect, incidental, special, or consequential damages (including loss of profits or data) arising out of the use or inability to use the Service, even if we have been advised of the possibility of such damages.

We reserve the right to modify, suspend, or discontinue parts of the Service at any time without prior notice.

2. License

DevRelic LLC grants you a revocable, non-exclusive, non-transferable, limited license to install and use RUSH strictly in accordance with these Terms. You agree not to:

• Reproduce, resell, distribute, or sublicense the app or website content.

• Reverse-engineer, decompile, or modify the app code.

• Remove any copyright, logo, or trademark notice from the Service.

Violation of these Terms may result in suspension or termination of your account without notice.

3. Definitions

• “App” or “Service” refers to the RUSH mobile application and website.

• “Company” refers to DevRelic LLC.

• “You” or “User” refers to the person or entity using the Service.

• “Subscription” refers to a paid plan that unlocks premium features.

• “Device” means any internet-connected device such as a phone, tablet, or computer.

• “Third-Party Services” means external APIs, providers, or analytics platforms integrated with RUSH.

4. Use of AI Technologies

RUSH uses advanced AI models to generate text, images, and other outputs. These results may not always be accurate, unique, or complete.
You acknowledge that:

• RUSH’s outputs are for informational and entertainment purposes only.

• You should not rely on AI-generated outputs as professional, medical, legal, or financial advice.

• You are fully responsible for your inputs and any data you provide.

RUSH and DevRelic are not affiliated with any specific AI model providers (e.g., OpenAI, Anthropic, Google, Meta) but may integrate their technologies for better user experience.

5. Account and Subscription

Users may access RUSH for free or subscribe to a paid plan. Subscriptions renew automatically unless canceled at least 24 hours before renewal (see Subscription Terms).
You are responsible for safeguarding your account credentials and all activities under your account.

Deleting the app does not cancel your subscription.

6. Intellectual Property

All content, software, designs, graphics, and data within the RUSH Service are the exclusive property of DevRelic LLC or its licensors.
You may not copy, modify, or redistribute any part of RUSH without written permission.

7. User Content and Suggestions

Any suggestions, feedback, or ideas you submit to DevRelic may be used freely without compensation.
By submitting feedback, you grant DevRelic a perpetual, worldwide, royalty-free license to use and modify your submissions.

8. Third-Party Services and Links

RUSH may contain links or integrations with third-party platforms such as payment processors, analytics providers, or AI model APIs.
DevRelic is not responsible for the content, accuracy, or security of third-party services and disclaims all associated liability.

9. Analytics and Tracking

RUSH may use analytics tools such as Google Analytics, Microsoft Clarity, or similar services to improve functionality. These tools collect anonymized usage data to analyze user behavior.
By using RUSH, you consent to this data being processed according to our Privacy Policy.

10. Account Deletion and Data Removal

Users can delete their accounts from within the app or via written request to support@devrelic.com.
Account deletion permanently removes all associated data, including chat history, files, and payment records.
This action is irreversible, and deleted data cannot be recovered.

11. Termination

We reserve the right to suspend or terminate your access if you violate these Terms, misuse the Service, or engage in prohibited activities.
You may terminate this agreement by deleting your account and discontinuing all use of RUSH.

12. No Warranties

RUSH is provided “as is” and “as available,” without warranties of any kind.
We do not guarantee that:

• The app will function without interruption or errors.

• Content generated by AI will be accurate or appropriate.

• The Service will be available at all times or compatible with your device.

Some jurisdictions do not allow limitation of implied warranties, so parts of this section may not apply to you.

13. Limitation of Liability

To the fullest extent permitted by law, DevRelic LLC and its affiliates shall not be liable for:

• Any indirect, incidental, or consequential damages.

• Any loss of data, revenue, or business opportunity.

• Any errors or inaccuracies in AI-generated content.

If liability cannot be excluded, our total liability shall not exceed the amount you paid for your subscription within the past 12 months.

14. Indemnification

You agree to defend, indemnify, and hold harmless DevRelic LLC and its affiliates from any claims, damages, or expenses (including attorney’s fees) arising from:

• Your use or misuse of RUSH.

• Your violation of these Terms.

• Your infringement of any third-party rights.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles.
Any dispute shall be resolved exclusively in the state or federal courts located in Wyoming.
By using RUSH, you consent to the jurisdiction of these courts.

16. Amendments to These Terms

We may revise these Terms from time to time.
If changes are material, we will provide notice via email or in-app notification at least 30 days before new terms take effect.
Your continued use of RUSH after the updated Terms become effective constitutes acceptance.

17. Disclaimer for Virtual AI Assistants

RUSH includes "AI-generated virtual assistants" for entertainment, educational, or advisory purposes. These assistants:

• Do not represent real people.

• Do not provide medical, legal, or financial advice.

• Are entirely AI-generated and fictional.

All interactions should be understood as simulated and non-human.
